General terms and conditions of sale for tourist packages ("General Terms and Conditions")

  1. CONTENTS OF THE TOURIST PACKAGE CONTRACT

1.1 By sending the proposal to purchase the tourist package, travelers confirm that they have read and accepted these General Conditions, on behalf of themselves and on behalf of the persons for whom they are requesting the tourist package services.

 

  2. APPLICABLE REGULATIONS

2.1 The package tour contract, both for services to be provided in Italy and abroad, is governed by Legislative Decree No. 79 of May 23, 2011 - Annex I, Articles 32-51-novies, as amended by Legislative Decree No. 62 of May 21, 2018 ("Tourism Code") and, if and to the extent applicable, by Law No. 1084 of December 27, 1977 (Ratification and implementation of the International Convention on Travel Contracts (CCV) signed in Brussels on 23.4.1970) and by Legislative Decree 6.9.2005 no. 2006 ("Consumer Code"), as well as by the provisions of the Civil Code, including those relating to transport and agency, as applicable.

2.2 The individual clauses of these General Terms and Conditions shall be considered independent of each other; the total or partial invalidity of a single clause or paragraph shall not invalidate any other clause or paragraph of these General Terms and Conditions.

   3. DEFINITIONS

3.1 Electric-Trips S.r.l. is considered the "organizer" of the tourist package for the purposes of the Tourism Code.

3.2 Electric-Trips S.r.l. is to be considered the "seller" of the tourist package within the meaning and for the purposes of the Tourism Code.

3.3 "Tourist package" means the combination of at least two different types of tourist services such as:

  • passenger transport;

  • accommodation, which is not an integral part of passenger transport and is not intended for residential purposes or for long-term language courses;

  • the rental of cars, other motor vehicles in accordance with the Ministerial Decree of April 28, 2008, or motorcycles that require a category A driving license, in accordance with Legislative Decree No. 2 of January 16, 2013;

  • any other tourist service that is not an integral part of one of the tourist services referred to in points (a), (b) and (c), and is not a financial or insurance service for the same trip or vacation, if at least one of the following conditions is met:

  • such services are combined by a single professional, even at the request of the traveler or in accordance with a selection made by the traveler, before a single contract for all services is concluded;

  • these services, even if concluded with separate contracts with individual suppliers, are:

  • purchased at a single point of sale and selected before the traveler agrees to pay;

  • offered, sold, or invoiced at a total price or inclusive price;

  • advertised or sold under the name "package" or a similar name;

  • combined after the conclusion of a contract whereby the professional allows the traveler to choose from a selection of different types of tourist services or purchased from separate professionals through linked online booking processes where the traveler's name, payment details and email address are transmitted by the professional with whom the first contract is concluded to one or more professionals and the contract with the latter professional(s) is concluded no later than 24 hours after the confirmation of the booking of the first tourist service.

 

"Package tour contract" means a contract relating to the entire package tour or, if the package tour is provided on the basis of separate contracts, the set of contracts relating to the tourist services included in the package tour.

"Traveler" or "tourist" means any person who intends to conclude a contract, enter into a contract, or is authorized to travel under a contract concluded within the scope of this paragraph.

"Professional" means any natural or legal person, whether public or private, who, in the course of his commercial, industrial, craft or professional activity, acts in contracts, including through another person acting in his name or on his behalf, as an organizer, seller, facilitator of related tourist services or provider of tourist services, in accordance with the applicable legislation.

"Organizer" means a professional who combines tourist packages and sells or offers them for sale directly or through or together with another professional, or the professional who transmits the data relating to the traveler to another professional.

"Seller" means a professional other than the organizer who sells or offers for sale tourist packages combined by an organizer.

"Durable medium" means any instrument which enables the traveler or the professional to store information addressed personally to them in a way accessible for future reference by means of a system for data recording and which allows the unchanged reproduction of the information stored.

"Unavoidable and extraordinary circumstances" means a situation beyond the control of the party invoking such circumstances and the consequences of which would not have been avoided even if all reasonable measures had been taken.

"Lack of conformity" means a failure of the tourist services included in a tourist package.

"Point of sale" means any premises, mobile or immobile, used for retail sales, or a retail website or similar online sales tool, even if retail websites or online sales tools are presented to travelers as a single tool, including telephone service.

"Return" means the return of the traveler to the place of departure or to another place agreed by the contracting parties.

"Place of departure" means the city from which the traveler independently took the first flight/train to reach the destination of the start of the package tour.

"Transfer service" means an optional service that may supplement the package tour, ensuring the transfer of the traveler to and/or from the airport of the tour destination. Provided by Electric-Trips at an additional cost, the service is only available after payment of the trip for a selection of itineraries. The traveler will receive details of the terms and conditions of purchase by email, together with a form for entering flight details.

"Basic booking" means a booking made without selecting any additional options such as, for example, the BE SAFE option.

"BE SAFE" means the paid option which, if available, guarantees the possibility of canceling the trip within a specified period prior to departure (indicated in Article 11.2 of these Terms and Conditions of Sale and pre-contractual information for each tourist package) and receiving a full refund of the amount paid (except for the amount relating to the Flexible cancellation option).

  4. MANDATORY INFORMATION AND TECHNICAL DATA SHEET

4.1 Before concluding the package tour contract, Electric-Trips shall provide the traveler with the following information in a clear and precise manner, either in the catalog on the web pages relating to the chosen destination, or in a quote or other information tool:

  • the fundamental rights under EU Directive 2015/2302

  • the main characteristics of the tourist services, such as:

  • the destination or destinations of the trip, the itinerary and the periods of stay with the relevant dates and, if accommodation is included, the number of nights included;

  • an indication of the type of quality of the accommodation facilities provided;

  • the type of transport to be used during the trip;

  • meals, if included;

  • visits, excursions, or other services included in the agreed price;

  • tourist services provided to the traveler as a member of a group and, in this case, the approximate size of the group;

  • the trade name and geographical address of Electric-Trips, its telephone numbers and email addresses;

  • the total price of the tourist package;

  • the methods of payment, including any amount or percentage of the price to be paid as a deposit and the schedule for payment of the balance, or the financial guarantees that the traveler is required to provide;

  • the minimum number of persons required for a specific tourist package;

  • general information concerning passports and/or visas, including the approximate time required for obtaining visas and the health formalities of the country of destination;

  • information on the right of the traveler to withdraw from the contract before the start of the package tour, in accordance with Article 41 (7) of the Tourism Code;

  • information on the optional or compulsory purchase of insurance covering the costs of unilateral withdrawal from the contract by the traveler or the costs of assistance, including repatriation, in the event of accident, illness, or death;

  • details of the coverage referred to in Article 47, paragraphs 1, 2, and 3 of Legislative Decree 62/2018.

4.2 Information relating to the trip not contained in the contract documents, in the catalog, on the Electric-Trips website or in other means of communication will be provided by Electric-Trips to the traveler, in accordance with the provisions of the Tourism Code, in good time before the start of the trip.

Pursuant to Article 47 of the Tourism Code, Electric-Trips has taken out a specific insurance policy which guarantees, in the event of insolvency or bankruptcy of Electric-Trips SRL, the reimbursement of the price paid for the purchase of the tourist package, in addition to any expenses incurred for the repatriation of the traveler: GUARANTEE FUND "IL SALVAGENTE" referred to in document no. 2025 - 1-8068 issued by ASSOCIAZIONE ITALIANA AGENTI DI VIAGGIO through SALVAGENTE S.c.a.r.l.

For further details regarding the benefits of insurance protection in the event of insolvency and bankruptcy, please refer to Articles 47 and 48 of the Tourism Code.

    5. FITNESS TO TRAVEL

5.1 Travelers are invited to carefully review the travel program and these General Conditions in order to have full knowledge of Electric-Trips' offer, as well as the type and characteristics of the trips. It is the traveler's responsibility to choose a trip that is suitable for their physical and mental condition and to contact Electric-Trips at the email address info@electric-trips.com in case of doubts or requests for clarification in this regard.

5.2 Each travel program is characterized by a series of adjectives that represent the type and fundamental characteristics of the trip; through these adjectives, the traveler is informed about the level of commitment required for the trip and can obtain useful information to decide whether or not the characteristics of the trip are compatible with their physical and mental condition.

5.3 The tourist packages offered by Electric-Trips are not suitable for all types of travelers. In the case of travelers with reduced mobility or people requiring specific medical assistance, the traveler must contact Electric-Trips before booking at the email addressinfo@electric-trips.com for more information about the trip and to agree, if possible, on any special arrangements necessary or useful to enable participation in the trip in safety.

5.4 For any requests and/or clarifications regarding the characteristics of the chosen trip, travelers are invited to specify these in the booking request or by contacting Electric-Trips.

5.5 Electric-Trips reserves the right to refuse the booking or departure of the traveler if the characteristics of the trip booked are incompatible or excessively risky for the health or safety of the traveler. In this case, Electric-Trips will refund the amount already paid, net of any non-refundable expenses incurred up to the time of refusal of the booking and/or departure. Similarly, the cost of flights and other services purchased individually will not be refunded.

 

    6. CONCLUSION OF THE TOURIST PACKAGE CONTRACT. PAYMENTS AND PRICE

6.1 The traveler must make the purchase offer for the tourist package in the manner indicated by Electric-Trips on its website. The traveler and Electric-Trips may also agree on different methods than those indicated on the website. The confirmation of purchase of the tourist package may, in any case, be stored on a durable medium. The conclusion of the tourist package contract is effective when Electric-Trips sends the confirmation of booking of the services requested to the traveler.

6.2 Upon sending the purchase proposal, the traveler must pay: a) a registration or administrative fee, if requested by Electric-Trips; b) a deposit on the price of the tourist package, which may vary depending on the tourist package selected by the traveler. Electric-Trips will always inform the traveler of the amount of the deposit applied. The balance must be paid without exception by the deadline set by Electric-Trips at the time of booking confirmation. If the balance is not paid by the deadline, the booking will be considered canceled and Electric-Trips will not refund the deposit paid (considering the amount as a penalty).

6.3 The price of the tourist package is determined by reference to the information provided in the catalogs and on the Electric-Trips website. The price may be increased only as a result of exchange rates applied to the tourist package, transport costs or taxes and fees on tourist services imposed by third parties not directly involved in the execution of the package. For such changes, reference will be made to the exchange rates and prices in force on the date of publication of the program, as stated in the catalog, or on the date stated in any updates published on the websites. In any case, the price cannot be increased in the 20 days prior to departure and the revision cannot exceed 8% of the original price, except in such cases where the traveler has the right to withdraw. In the event of a decrease in the costs relating to transport or taxes and fees on tourist services imposed by third parties not directly involved in the execution of the package referred to in this clause, the traveler shall be entitled to a reduction in the price of the package; Electric-Trips may deduct administrative and management costs from the refund due to the traveler.  

    7. PRICE OF THE PACKAGE BEFORE PURCHASE

7.1 The price may be subject to change depending on market conditions.

7.2 Electric-Trips reserves the right to offer the traveler, at the time of sale of the tourist package and in accordance with the law, various promotions, including, by way of example, price reductions, bonuses, and other benefits. Electric-Trips reserves the right not to apply certain promotions to travelers who do not meet the relevant conditions of applicability:

  • promotions are not applicable to travelers who have already made a booking for the same trip.

     8. GENERAL DEPOSIT CONDITIONS for On-demand Travel

8.1 In the case of a trip listed on the electric-trips.com website, the interested party may request availability for the trip directly using the form provided during the purchase process.

8.2 In order to ascertain the actual availability of the trip on demand, Electric-Trips requires a deposit of €100, to be paid exclusively by credit/debit card. Within 48 working hours of payment, Electric-Trips shall either:

  • confirm and complete the booking of the interested party;

  • refund the amount paid if it has not been possible to complete the trip booking

8.3 If Electric-Trips is able to finalize the On Demand package proposal, the company will ask the participant for all the information necessary to complete the booking. The deposit of €100 will be deducted from the booking balance and will not replace the deposit that must be paid in order to confirm the booking.

8.4 If the interested party decides not to participate in the trip, the deposit of €100 will not be refunded.

 

    9. BOOKING USING CREDIT FROM A WELFARE PLATFORM

9.1 Users can book their trip on the website www.electric-trips.com using their welfare credit from the welfare platform used by their company.

9.2 Considering that booking with welfare credit involves both the welfare platform with its own regulations and the Electric-Trips.com platform, the following steps must be followed.

9.3 Before proceeding with the credit request via the welfare platform, the user must:

  • Write toinfo@electric-trips.com to check if the trip you are interested in is actually available.

  • Once availability has been confirmed, the Electric-Trips operator will block the trip, only after the user has confirmed that they have the credit available (the welfare credit must cover the total cost of the trip, and must therefore be of equal or greater value). The user is required to request the credit from their welfare platform within 48 working hours of Electric-Trips confirming availability for the trip in question and must then send confirmation to info@electric-trips.com

  • If the request is not sent within 48 hours, the offer will be canceled.

9.4 With payment via welfare credit, it is possible to add the BE SAFE Option provided during the booking process if part of the welfare credit cannot be paid by any other form of payment. If the option is used within the terms provided, an Electric-Trips voucher will be issued for a value equal to one year's worth of the travel package, net of the BE SAFE fee, which will be retained.

9.5 Welfare credit can be used by the employee and their family members (family members are defined as spouses who are not legally and effectively separated, children, including adopted or foster children, but also parents, parents-in-law, brothers, and sisters).

9.6 After requesting the allocation of credit for Electric-Trips on their welfare platform, the Electric-Trips operator will create a personal promo code that can be used during the booking process. This code, once sent to the user, must be used WITHIN 48 working hours. The previously reserved place will be released by WeRoad once the unique personal code required to make the booking has been sent. It is therefore recommended that you make your booking on the website as soon as possible. If the code provided by Electric-Trips is not used within 48 hours, Electric-Trips will deactivate the code and it can no longer be used or refunded.

9.7 Welfare codes cannot be combined with other promotional codes or gift cards and can only be used on new bookings. Users may decide to cancel their trip and rebook using their welfare credit if the departure is scheduled for more than 31 days in advance; in this case, Electric-Trips cannot guarantee the actual availability of the trip.

9.8 In the event of cancellation of a trip booked using welfare credit:

  • the user may cancel in accordance with the terms and conditions of the trip cancellation policy. Electric-Trips will issue a voucher;

  • users who wish to change their trip must cancel their trip by writing to booking@electric-trips and rebook the new trip they are interested in. The traveler will be required to pay any difference in price between the new trip and the original trip; any discounts obtained on the original trip cannot be transferred to the new trip;

  • the user will contact the welfare platform to manage any incorrect issuance of credit.

    10. CHANGES TO OTHER TERMS OF THE PACKAGE TOUR CONTRACT OTHER THAN THE PRICE

10.1 Electric-Trips reserves the right to unilaterally modify the travel program if the modification is of minor importance. Any modifications shall be communicated clearly and precisely to the traveler, on a durable medium and to the contact details provided by the traveler.

10.2 If, prior to departure, Electric-Trips (i) needs to significantly modify one or more elements of the package tour contract; (ii) cannot meet specific requests made by the traveler and already accepted by Electric-Trips; or (iii) proposes an increase in the price of the package of more than 8% of the total price of the package, Electric-Trips shall inform the traveler by email, without undue delay, in a clear and precise manner of the proposed changes in accordance with this article and their impact on the price of the package, as well as the possibility and methods for the traveler to exercise the right of withdrawal if he/she does not intend to accept the proposed changes.

10.3 If the traveler does not accept Electric-Trips' proposed changes, exercising their right of withdrawal, Electric-Trips may offer the traveler a replacement package of equivalent or higher quality or, at the traveler's choice, refund the entire amount already paid, including the registration/administration fee if paid in advance at the time of the purchase of the tourist package.

10.4 The traveler shall notify Electric-Trips or the intermediary of their acceptance of the changes/withdrawal from the tourist package contract within three working days in the case of departures less than 30 days from the time they received the notice, or within seven working days in the case of departures more than 30 working days from the time they received the notice. Failure to communicate within the above deadline shall mean that the proposed changes made by Electric-Trips are accepted.

  • If the changes to the package tour contract result in a package of lower quality or cost, the traveler is entitled to an appropriate price reduction.

  • If the traveler exercises their right of withdrawal, Electric-Trips will refund all amounts paid by the traveler without undue delay and in any case no later than 14 days from the exercise of the right of withdrawal.

 

     11. WITHDRAWAL BY THE TRAVELER BEFORE DEPARTURE

11.1 Before departure, the traveler may withdraw from the contract without penalty in the following cases:

  •  by exercising the right provided for in Article 41 (7) of the Tourism Code;

  • at any time and without providing any justification up to 31 days before departure;

  • in the event of an increase in the price of the tourist package exceeding 8% of the total price of the package;

  • in the event of a significant change to one or more elements of the contract that can objectively be considered essential for the enjoyment of the package as a whole, proposed by Electric-Trips after the conclusion of the contract but before departure and not accepted by the traveler;

  • in the event of unavoidable and extraordinary circumstances occurring at the place of destination or in its immediate vicinity that have a substantial impact on the safe execution of the package, without the right to any additional compensation;

  • impossibility of using the tourist package for reasons not attributable to the traveler, duly documented and communicated in a timely manner; the traveler shall be entitled to a refund of the price paid, net of documented expenses incurred by Electric-Trips up to the time of notification of the impossibility of participating in the trip.

11.2In cases where the traveler has purchased the "BE SAFE" option:

  • if the withdrawal is exercised within 8 days prior to departure, they will be entitled to a refund of the Basic Booking but not of the amount relating to the BE SAFE option and the Transfer Service (if purchased);

  • if the traveler withdraws after the above deadline, the traveler will not be entitled to any refund of the amounts paid for the Basic Booking, BE SAFE Option, and Transfer Service.

11.3 The BE SAFE option is not available when using welfare vouchers.

 

    12.FAILURE TO CONCLUDE THE CONTRACT

12.1 In the event that Electric-Trips, at its sole discretion, does not accept the traveler's purchase proposal, the deposit paid will be refunded in full.

     13.WITHDRAWAL BY ELECTRIC-TRIPS BEFORE DEPARTURE

13.1 Electric-Trips may withdraw from the package tour contract at any time and offer the traveler a full refund of the payments made for the package tour, but is not required to pay additional compensation if:

Electric-Trips is unable to perform the package tour contract due to unavoidable and extraordinary circumstances and notifies the traveler of the withdrawal without undue delay before the start of the package tour. If unavoidable and extraordinary circumstances affect activities on site, Electric-Trips shall not be required to reimburse any amount resulting from the non-enjoyment or non-performance of such activities.

13.2 The flight will only be refunded (upon presentation of proof of purchase in Economy class) if Electric-Trips withdraws from the package tour contract in relation to a confirmed flight. The refund will be made on condition that the flight was purchased by the traveler before notification of withdrawal and upon proof of cancellation of the flight booking.

13.3 Electric-Trips will make all required refunds without undue delay and in any case within the time limit established by law. The withdrawal of Electric-Trips entails the termination of functionally related contracts entered into with third parties, without any liability on the part of Electric-Trips.

     14.ELECTRIC-TRIPS' LIABILITY FOR INCORRECT PERFORMANCE OF THE PACKAGE AND FOR THE IMPOSSIBILITY OF PERFORMING THE PACKAGE DURING ITS PERFORMANCE

14.1 Electric-Trips is responsible for the performance of the tourist services provided for in the package tour contract, regardless of whether such tourist services are to be provided by Electric-Trips itself or by third parties pursuant to Article 1228 of the Civil Code.

14.2 The traveler, in accordance with the obligations of fairness and good faith referred to in Articles 1175 and 1375 of the Civil Code, shall promptly inform Electric-Trips, taking into account the circumstances of the case, of any lack of conformity detected during the performance of a tourist service provided for in the tourist package contract. The complaint must be made by means of a written statement addressed to Electric-Trips at the email address booking@electric-trips.com or at the certified email address: electric-trips@pec.it

14.3 Where expressly included in the package tour, essential information regarding visits/excursions or other tourist services shall be clearly indicated in the itinerary and also included in the "What is included" section thereof. Otherwise, visits/excursions or other tourist services indicated in the itinerary shall be considered optional and not included in the price of the package tour.

14.4 Electric-Trips shall remedy the lack of conformity, unless this is impossible or excessively burdensome, taking into account the extent of the lack of conformity and the value of the tourist services affected by the lack of conformity.

14.5 If Electric-Trips does not remedy the defect in accordance with paragraph 3 above, the traveler is entitled to a price reduction and compensation for any damage suffered as a result of the lack of conformity, unless Electric-Trips proves that the lack of conformity is attributable to the traveler or to a third party or is due to unforeseeable, extraordinary, and unavoidable circumstances.

14.6 Without prejudice to the exceptions set out in paragraph 4 above, if Electric-Trips fails to remedy the lack of conformity within a reasonable period set by the traveler in the complaint made in accordance with paragraph 2, the traveler may remedy the defect himself and request reimbursement of the necessary, reasonable, and documented expenses; if Electric-Trips refuses to remedy the lack of conformity or if it is necessary to remedy it immediately, the traveler does not need to specify a deadline.

14.7 If, after departure, Electric-Trips is unable to provide, for any reason other than the traveler's own fault, an essential part of the services included in the package tour contract, it shall arrange suitable alternative solutions for the continuation of the planned trip at no extra cost to the traveler, or reimburse the latter for the difference between the services originally provided and those provided.

14.8 The traveler may refuse the alternative solutions proposed only if they are not comparable to what was agreed in the contract or if the price reduction granted is inadequate.

14.9 If no alternative solution is possible, or if the solution provided by Electric-Trips is refused by the traveler because it is not comparable to what was agreed in the contract or because the price reduction granted is inadequate, Electric-Trips shall, without any additional charge, provide a means of transport equivalent to the original means of transport for the return to the place of departure or to a different place agreed upon, depending on the availability of means of transport and seats, and shall reimburse the difference between the cost of the services provided and the cost of the services performed until the time of early return.

    15. OBLIGATIONS OF THE TRAVELER

15.1 The traveler is required to read and accept these General Conditions before sending the booking request.

15.2 During the negotiations and in any case before the conclusion of the contract, the traveler shall be provided in writing with up-to-date general information on health requirements and the documentation necessary for travel abroad.

15.3 Travelers must in any case inform Electric-Trips of their citizenship at the time of booking the tourist package or tourist service and, at the time of departure, must ensure that they are in possession of vaccination certificates, individual passports and any other documents valid for all countries included in the itinerary, as well as any visas, transit visas and health certificates that may be required. Travelers also undertake to send Electric-Trips a copy of their individual passport and any other document valid for all countries included in the itinerary within 45 days of departure. If travelers do not provide the required documentation and the departure date is less than 45 days away, Electric-Trips may not be able to guarantee participation in the trip or the price of the package may change; therefore, it reserves the right to withdraw from the contract.

15.4 Without prejudice to Electric-Trips' information obligations, in order to assess the socio-political and health situation and any other useful information relating to the countries of destination and, therefore, the objective usability of the services purchased or to be purchased, the traveler shall be responsible for obtaining official general information from the Ministry of Foreign Affairs, published on the institutional website of the Farnesina www.viaggiaresicuri.it and the website of the World Health Organization – International Travel and Health portal (https://www.who.int/ith/en/). The above information is not contained in tour operators' catalogs, either online or in print, as these contain general descriptive information and not information that is subject to change over time. Therefore, travelers are responsible for obtaining this information. In any case, travelers shall, before departure, check that the information is up to date with the competent authorities (for Italian citizens, the local police headquarters or the Ministry of Foreign Affairs via the website www.viaggiaresicuri.it or the Operations Center at 06.491115) and comply with it before traveling.

15.5 Electric-Trips cannot be held liable for the failure of one or more travelers to depart if, despite having received all the necessary information, they have not taken steps to obtain the documents, certificates, or vaccinations required to undertake the trip.

15.6 Without prejudice to Electric-Trips' information obligations, if, on the date of booking, the chosen destination is subject to a "warning" for security reasons, as reported by official information channels, travelers who subsequently withdraw from the contract cannot invoke the termination of the contract due to the security conditions in the country.

15.7 Travelers/tourists must behave in such a way as to ensure and not compromise the safety, peace, and enjoyment of the trip for other travelers/tourists.Travelers must also behave appropriately with Electric-Trips customer service staff both before and after booking and comply with the rules of normal prudence and diligence and those specific to the countries of destination, with all the provisions provided to them by Electric-Trips, as well as with the regulations, administrative or legislative provisions relating to the tourist package. The traveler will be liable for all damages that Electric-Trips and/or the seller may suffer as a result of failure to comply with the above obligations, including the costs necessary for their repatriation.

15.8 The traveler is required to provide Electric-Trips with all documents, information, and elements in their possession that are useful for the exercise of the latter's right of subrogation against third parties responsible for the damage and is liable to Electric-Trips for any prejudice caused to the right of subrogation.

15.9 The traveler shall also notify Electric-Trips in writing, at the time of the proposal to purchase the tourist package and therefore before the sending of the confirmation of the booking of the services by Electric-Trips, of any special personal requests that may be the subject of specific agreements on the travel arrangements, provided that they can be implemented and that they will in any case be the subject of a specific agreement between the traveler and Electric-Trips.

    16. REFUSAL OF NEW BOOKINGS

16.1 Electric-Trips reserves the right to cancel new bookings made by travelers who, on previous trips or in their dealings with Electric-Trips, have been reported by partner accommodation providers, transport rental companies, or experience partners as not having behaved in a manner consistent with good conduct. If, despite prior notification of refusal of new bookings, the traveler makes a new booking, Electric-Trips reserves the right to cancel such booking within 30 days of the booking. In this case, Electric-Trips will refund the full amount paid by the traveler as a deposit or booking fee, excluding any further sums or compensation for any additional damages.

    17. FINES, EXCESSES, AND DAMAGE CAUSED WHILE DRIVING VEHICLES

17.1 The traveler is responsible for the payment of any fines and other penalties, the payment of any excess and compensation for any damage caused to persons or property while driving vehicles used during the trip; the traveler responsible for the accident will also be responsible for the payment of any management costs incurred by the Destination Management Company.

 

    18. TRANSFER OF THE PACKAGE TOUR CONTRACT TO ANOTHER TRAVELER

18.1 The traveler, upon prior notice given to Electric-Trips on a durable medium and no later than 7 days before the start of the tourist package, may transfer the tourist package contract to a person who meets all the conditions for using the service.

18.2 Electric-Trips shall inform the transferor of the actual costs of the transfer, providing proof of any fees, taxes, or other additional costs resulting from the transfer of the contract.

18.3 The transferor and transferee of the package tour contract are jointly and severally liable for the payment of the balance of the price and any additional fees, taxes, and other costs, including any administrative and handling fees resulting from such transfer.

    19. MEDICAL AND LUGGAGE INSURANCE AND CANCELLATION INSURANCE

19.1 The price of the package includes medical and baggage insurance. Electric-Trips will inform the traveler of the details of the coverage in the section relating to the trip and in the booking confirmation email. Before departure, Electric-Trips will send the traveler the details of the insurance coverage that can be activated by the traveler in the event of an accident. The traveler is required to read the insurance coverage conditions and assess whether they meet their needs.

19.2 The traveler is entitled to take out special insurance to cover the costs of withdrawal (always due except for the specific exceptions provided for by the Tourism Code, and unless otherwise provided for in these General Conditions) referred to in Article 10, as well as those arising from accidents and/or illnesses not covered by the medical and baggage insurance included in the price of the package. The rights arising from insurance contracts must be exercised by the traveler directly against the contracting insurance companies, under the conditions and in the manner provided for in the policies themselves, paying particular attention to the deadlines for reporting the claim, deductibles, limitations, and exclusions. When booking, travelers must inform Electric-Trips of any specific needs or issues that may require and/or make it necessary to take out policies other than those offered by Electric-Trips or included in the price of the tourist package.

  20. GUARANTEES FOR THE TRAVELER

20.1 Electric-Trips is covered by an insurance contract for civil liability in favor of the traveler for compensation for damages resulting from the breach of obligations assumed under the contract

(Civil Liability Policy: EUROP ASSISTANZE No. 2628132).

20.2 Organized tourism contracts are covered by appropriate guarantees provided by the organizer and/or seller which, for trips abroad and trips taking place within a single country, ensure, in the event of insolvency or bankruptcy of the intermediary or organizer, the refund of the price paid for the purchase of the tourist package and the immediate return of the traveler.

20.3 The legal entity required to provide the guarantee on behalf of Electric-Trips is the GUARANTEE FUND "IL SALVAGENTE" referred to in document no. 2025 -1-8068 issued by ASSOCIAZIONE ITALIANA AGENTI DI VIAGGIO through SALVAGENTE S.c.a.r.l.

    21. CONTACTING ELECTRIC-TRIPS, COMPLAINTS, AND ALTERNATIVE DISPUTE RESOLUTION

21.1 The traveler may send messages or requests relating to the execution of the tourist package directly to Electric-Trips by email (info@electric-trips.com ).

21.2 The traveler is required to communicate in writing, without delay, any lack of conformity detected during the execution of the package, to the email address or via certified email. electric-trips@pec.it

21.3 The traveler is entitled to use the Online Dispute Resolution service provided by the European Commission (https://ec.europa.eu/consumers/odr/main/?event=main.home2.show) or to resort to voluntary or joint negotiation procedures or to the conciliation procedure before arbitration or conciliation commissions for the resolution of disputes between businesses and consumers and users relating to the provision of tourist services referred to in Article 67, paragraph 2, of Annex 1 to Legislative Decree No. 79 of May 23, 2011 (Tourism Code).

   22. OBLIGATION TO PROVIDE ASSISTANCE

22.1 Electric-Trips shall provide adequate assistance without delay to travelers in difficulty, in particular by providing appropriate information on health services, local authorities, and consular assistance, and by assisting travelers in making remote communications and helping them find alternative tourist services. 22.2 Electric-Trips may charge a reasonable fee for such assistance if the problem is caused intentionally by the traveler or through their fault, within the limits of the expenses actually incurred.

   23.DISCLAIMER

23.1 During the trip, the customer may share photos and videos of the trip, which may also include the traveler (the "Images") to allow them to participate more fully in the trip purchased, as well as for advertising purposes.

23.2 By purchasing the Tour Package – and therefore accepting the General Terms and Conditions – the traveler grants Electric-Trips the right to use, distribute, reproduce, process, modify, publish, communicate to the public, and transmit, on any medium, including social network pages, the Images for the informational and promotional purposes of Electric-Trips. In any case, the traveler is free not to participate in the photo shoots/filming and/or to revoke this authorization at any time by writing to Electric-Trips.

    24. APPLICABLE LAW – JURISDICTION

24.1 The tourist package and the tourist package contract are governed by Italian law. Any dispute arising between the traveler and Electric-Trips regarding the validity, formation, execution, fulfillment, or termination of the tourist package contract shall be subject to the exclusive jurisdiction of the court where the traveler has their residence or domicile.

    25. PRIVACY

25.1 The traveler authorizes the organizer to use and communicate to third parties their personal data in relation to obligations connected with the package tour contract in accordance with the current European Regulation on privacy and personal data protection.

   26. INDIVIDUAL TOURIST SERVICES AND RELATED TOURIST SERVICES

26.1 Contracts for the provision of transport services only, accommodation services only, or any other separate tourist service cannot be considered as travel arrangements or package tours and are not covered by the protections provided for in the Tourism Code. Such contracts are subject to the contractual terms and conditions of the individual supplier and the applicable laws. The service provider is responsible for the proper performance of the contract.

26.2 In the case of bookings for linked tourist services, the traveler is protected against the loss of payments made for services not provided due to the insolvency of the professional who collected the payments made by the traveler. This protection does not provide for any reimbursement in the event of the insolvency of the relevant service provider.
